What Is Divorce Mediation?

Divorce mediation is a structured process in which a neutral mediator assists separating or divorcing couples in discussing disputed issues and exploring possible agreements.

Rather than allowing disagreements to escalate unnecessarily, mediation gives parties an opportunity to identify the issues that need to be resolved, consider their options and work towards arrangements suited to their circumstances.

Mediation may help couples address:

  • Division of assets and financial arrangements.

  • Child and spousal maintenance.

  • Parenting responsibilities and contact arrangements.

  • Schooling, holidays and other issues affecting children.

  • The terms of a divorce settlement agreement.

Mediation is not suitable for every dispute, and an agreement cannot be guaranteed. Where appropriate, independent legal advice can help each party understand their rights and obligations.

From Mediation to Divorce Finalisation

One of the advantages of my practice is that I can assist with more than the mediation sessions themselves.

Where the parties reach agreement, I can assist with preparing the relevant documentation, including a divorce settlement agreement and, where required, a parenting plan.

Where the matter is suitable for an uncontested divorce, I can also assist with the legal steps required to finalise the divorce, including the necessary court process.

You may not need to approach a separate attorney after mediation. Whether I can assist with the entire process will depend on the circumstances of your matter, the agreement reached and any need for independent legal advice.

My aim is to provide continuity and clarity from the resolution of outstanding issues through to the appropriate next steps.

A parenting plan can record agreed arrangements concerning parental responsibilities and rights, where children will live, contact, schooling, healthcare, holidays and communication between parents.

Parenting plans may be relevant to divorcing parents as well as unmarried parents who need to regulate their parenting arrangements. Depending on the circumstances and applicable legal requirements, a parenting plan may be registered with the Family Advocate or made an order of court.

The purpose is to provide clarity, reduce avoidable disagreements and promote arrangements that serve the children’s best interests.

Divorce Settlement Agreements and Maintenance

A divorce settlement agreement records the arrangements reached between spouses on relevant matters arising from their divorce. Depending on the circumstances, it may address the division of assets, maintenance, property and arrangements for children.

I can assist with documenting agreed terms and explaining the steps involved in progressing an uncontested divorce.

Where maintenance arrangements need to be recorded separately, a maintenance agreement may also be appropriate.

What If Mediation Does Not Resolve Everything?

Not every couple will reach agreement on every issue. Sometimes only certain matters can be resolved through mediation, while other issues remain in dispute.

Where litigation becomes necessary, I also practise in family law and can advise on the legal options available in the circumstances.

The appropriate approach depends on the facts of the matter, the issues in dispute and the legal interests that need to be protected. Mediation should not delay urgent legal intervention or protection where this is necessary.
